1. Introduction
FTL Propertymix, LLC, doing business as CashHouseSales.com ("Company," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you visit cashhousesales.com (the "Website") or submit information through a form on the Website.
For purposes of this Policy, "Company" means FTL Propertymix, LLC, doing business as CashHouseSales.com. Where this Policy describes sharing information to evaluate, assign, or close a real estate transaction, that sharing may involve an affiliated or designated purchasing entity identified as Buyer in a purchase agreement, a later assignee where applicable, and third-party transaction participants such as title companies, escrow holders, and closing agents, in each case only as reasonably necessary to evaluate or complete the transaction, as described in Section 4.
2. Information We Collect
2.1 Information You Provide Through a Form
The lead form on the Website collects four items:
- Your name (optional);
- Your telephone number;
- Your email address;
- The address of the property you are inquiring about.
The form also records your consent, as described in Section 2.3.
2.2 Information You Provide During the Process
If we speak with you after your inquiry, you may choose to tell us more about the property and your situation — for example its condition, whether it is occupied, whether there is a mortgage or lien on it, your role with respect to the property, ownership history, your reasons for selling, or a mailing address for correspondence. You may also send us photographs. Providing any of this is voluntary; the Website has no upload feature and does not request it.
We do not record telephone calls. We may make temporary notes during or after a call to help us respond to your inquiry, and those notes may be discarded when they are no longer needed. Emails, text messages, voicemails, and other correspondence may remain in the systems through which they are sent or received until they are deleted in the ordinary course or retained as required by applicable law.
2.3 Consent Records
When you submit a form, the submission includes the exact consent language displayed to you, the date and time of your submission, and the URL of the page on which the form appeared. We retain this information only as long as reasonably necessary for the purposes described in this Policy or as required by applicable law.
2.4 Information Collected Automatically
When you visit the Website, we and our service providers may automatically collect:
- IP address and approximate geographic location derived from it;
- Device information including device type, operating system, and browser type and version;
- Pages visited, time spent on each page, referring URL, and exit pages;
- Date and time of access;
- Information collected through cookies and similar tracking technologies.
2.5 Information We Do Not Collect
We do not knowingly collect Social Security numbers, bank account numbers, payment card numbers, or government-issued identification numbers through the Website. The Website has no field requesting any of them. If you provide such information voluntarily in correspondence, we will not use it for any purpose other than the purpose for which you appear to have provided it.
3. How We Use Your Information
We use the information we collect to:
- Respond to your inquiry and contact you about the potential sale of your property;
- Evaluate your property and prepare or facilitate a potential offer to purchase;
- Negotiate, facilitate, perform, and close real estate purchase and sale transactions involving the Buyer identified in the applicable purchase agreement, including transactions in which that Buyer later assigns its contractual position where permitted;
- Call, text, and email you about your property inquiry and potential sale, consistent with the consent you provided;
- Verify your identity and authority with respect to the property;
- Maintain records of our transactions, communications, consent, and lead history;
- Operate, maintain, secure, and improve the Website and our services;
- Detect, prevent, and respond to fraud, security incidents, and other unlawful activity;
- Comply with applicable law, court orders, subpoenas, and lawful requests from government authorities;
- Enforce our Terms and Conditions and protect our rights.
4. How We Share Your Information
We do not sell your Personal Information, and we do not share it with third parties for their own independent marketing purposes. We may share your information only in the circumstances described below.
4.1 Transaction Participants
To evaluate your property and, if a purchase agreement is entered into, to perform, assign where permitted, and complete the transaction, we may share your information with an affiliated or designated purchasing entity identified as Buyer in the purchase agreement, any later assignee where applicable, and third parties reasonably necessary to complete the transaction — including title companies, escrow holders, and closing agents. This transaction-related sharing is limited to what is reasonably necessary to evaluate, perform, assign, or close the sale of your property, and it is not a sale of your information.
4.2 Service Providers
The Website uses a small number of service providers:
- Formspark — processes and stores submissions from the lead form and delivers them to us by email. If its transactional autoresponder is enabled, Formspark may also send a confirmation email to the email address submitted with the form. Formspark is the third-party service that receives what you type into the form.
- Our web host, which stores and serves the Website.
We require these service providers to use your information only for the purposes for which we share it with them and to maintain appropriate confidentiality and security measures. We may also use ordinary business tools such as email and cloud storage to handle correspondence with you.
4.3 Legal Requirements
We may disclose your information when required to do so by law, court order, subpoena, or other lawful request from a government authority, or when we believe in good faith that disclosure is necessary to (a) comply with a legal obligation, (b) protect our rights, property, or safety, or the rights, property, or safety of others, (c) investigate or prevent fraud or illegal activity, or (d) enforce our Terms and Conditions.
4.4 Business Transfers
If the Company is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, your information may be transferred as part of that transaction. We will provide notice on the Website of any such transfer.
5. Cookies and Tracking Technologies
The Website uses Google Analytics 4 (“Google Analytics”), a web analytics service provided by Google, to help us understand how visitors use the Website and improve its performance and usefulness. Google Analytics may collect information such as pages viewed, session activity, approximate geographic location, browser and device information, and other Website usage data. Google Analytics uses first-party cookies and similar technologies to distinguish users and sessions. Google states that IP addresses may be used during collection to determine general location information but are not logged or stored in Google Analytics.
Google processes this information to provide Website measurement and reporting services. We do not use Google Analytics to collect the information you enter into our lead forms, and we do not intentionally send names, email addresses, phone numbers, property addresses, or other information submitted through those forms to Google Analytics.
6. SMS and Text-Message Communications
6.1 How We Use Your Mobile Number
When you provide your mobile phone number through a form on the Website, we use it to respond to your specific property inquiry — for example, to call or text you about the property and a potential offer — and for the other purposes described in this Policy, consistent with the consent you provided when you submitted the number. We do not currently send marketing or promotional text messages. If we introduce marketing messages in the future, we will obtain your separate, optional consent before doing so.
6.2 Your Mobile Number Is Not Shared for Independent Marketing
We do not sell your mobile phone number or share it with third parties for their own independent marketing purposes. Your number may be shared only as reasonably necessary with service providers or transaction participants described in Section 4, consistent with this Policy and the consent you provided.
6.3 Message Frequency
You may receive text messages related to your inquiry. Message frequency varies depending on the nature of your inquiry and our communications with you.
6.4 Message and Data Rates
Standard message and data rates may apply when you receive text messages from us. These rates are determined by your mobile service provider and are beyond our control. We recommend checking with your mobile service provider for details on any applicable charges.
6.5 How to Opt Out
You may opt out at any time by replying STOP to any text, or by contacting us by phone, email, or any of the methods in Section 17. We honor opt-out requests received through any reasonable means, including by text, email, phone, voicemail, or web form. Requests are recorded on an internal do-not-contact list that we check before contacting anyone. See our consent and contact page for more detail.
7. Data Retention
We retain Personal Information only as long as reasonably necessary for the purpose for which it was collected, to comply with applicable law, resolve disputes, honor communication preferences, or enforce agreements. Retention varies by type of information. Information connected with a pending or completed real estate transaction may be kept longer when needed for transaction, title, tax, accounting, legal, or dispute-resolution purposes. Information relating only to an inquiry may be deleted when it is no longer needed. Temporary call notes may be discarded sooner. We may retain a limited suppression record, such as a phone number or email address and the scope of the request, when needed to remember and honor a request not to contact you. You may request deletion of your information subject to the rights described in Section 12 and any applicable legal obligation to retain particular records.
8. Data Security
We use commercially reasonable measures to protect your information from unauthorized access, use, alteration, disclosure, and destruction. However, no method of transmission over the internet and no method of electronic storage is completely secure, and we cannot guarantee absolute security. You provide information to us at your own risk.
9. Children's Privacy
The Website is not directed to children under the age of eighteen (18). We do not knowingly collect Personal Information from anyone under 18. If you believe a child under 18 has provided Personal Information to us through the Website, please contact us using the information in Section 17 and we will take steps to delete such information.
10. Communications by Phone, Text, and Email
When you submit a form on the Website and check the consent checkbox accompanying the form, you provide your prior express written consent for CashHouseSales.com and those acting on our behalf to contact you using the telephone number, email address, and physical address you provide, for purposes related to your inquiry and the potential sale of your property. The full terms of that consent are set out in the consent language displayed with the checkbox and explained on our consent and contact page.
We do not currently send marketing communications. If we introduce marketing contact in the future, we will obtain your separate, optional consent, and marketing consent will never be a condition of any sale. You may revoke consent at any time using any of the methods described in Section 6.5 or by contacting us using the information in Section 17. We honor opt-out requests received through any reasonable means. We comply with the Telephone Consumer Protection Act, the CAN-SPAM Act, and applicable state telemarketing and consumer-privacy laws.
11. CAN-SPAM Act Compliance
Any marketing emails we send will:
- Identify themselves as advertisements where required;
- Include our valid physical mailing address;
- Provide a clear method to unsubscribe from future marketing emails;
- Honor unsubscribe requests promptly, generally within ten (10) business days.
12. California Privacy Rights
If you are a California resident, you may have certain rights under California law — including the California Consumer Privacy Act and the California Privacy Rights Act (together, "CCPA/CPRA"), as amended — to the extent those laws apply to us. Depending on applicability, those rights may include:
- The right to know what categories of Personal Information we collect about you and the purposes for which we use it;
- The right to request access to the specific pieces of Personal Information we have collected about you;
- The right to request deletion of your Personal Information, subject to certain exceptions;
- The right to request correction of inaccurate Personal Information;
- The right to opt out of the sale or sharing of your Personal Information (as noted in Section 4, we do not sell or share Personal Information for cross-context behavioral advertising);
- The right not to receive discriminatory treatment for exercising these rights.
To the extent applicable law provides these rights, you may exercise them by contacting us using the information in Section 17. We will verify your identity before responding to a request and will respond within the timeframes required by applicable law.
12.1 California Online Privacy Protection Act (CalOPPA)
Consistent with the California Online Privacy Protection Act (CalOPPA), we conspicuously post this Privacy Policy on the Website, disclose the categories of personally identifiable information we collect, identify the categories of third parties with whom we may share information, describe how we notify users of material changes to this Policy (Section 16), and disclose how we respond to "Do Not Track" signals (Section 13).
13. Do Not Track Signals
Some browsers offer a "Do Not Track" signal. Because no common industry standard has been adopted for how to interpret these signals, the Website does not currently respond to them. We will update this Policy if that changes.
14. Links to Third-Party Websites
The Website may contain links to websites operated by third parties, including our Better Business Bureau profile and resources we reference regarding privacy or analytics. We are not responsible for the privacy practices of third-party websites. We encourage you to review the privacy policies of any third-party websites you visit.
15. Visitors From Outside the United States
The Website is operated from the United States and is intended for users within the United States. If you access the Website from outside the United States, your information will be transferred to and processed in the United States, where data-protection laws may differ from those of your country.
16. Changes to This Policy
We may update this Policy from time to time by posting a revised version on the Website. The "Last Updated" date at the top of this Policy indicates when the most recent changes were made. Your continued use of the Website after a revised Policy is posted constitutes your acceptance of the revised Policy.
